Please refer to our Product Care Guidelines for further information on caring for your handbag or small leather item.

STERLING SILVER JEWELLERY

The Michael Kors Sterling Silver Jewellery Warranty is a voluntary manufacturer’s warranty. It provides rights separate to rights provided by consumer law, including but not limited to those relating to non-conforming goods. Michael Kors’ limited warranty benefits are in addition to, and not instead of, rights provided by consumer law.

Your Michael Kors sterling silver jewellery is warranted by Fossil Group, Inc.* for a period of two (2) years from the original date of purchase, in each case under the terms and conditions of this warranty. The Michael Kors Sterling Silver Jewellery warranty covers materials and manufacturing defects. A copy of the receipt is required for proof of purchase.

In case of replacement, Michael Kors cannot guarantee that you will receive the same piece of sterling silver jewellery. If your piece is not available, a comparable piece of equal value and similar style will be substituted. The warranty for the replacement sterling silver jewellery piece ends two (2) years, from the date the replacement piece is received.

STERLING SILVER JEWELLERY WARRANTY DOES NOT COVER:

  • Damage resulting from, in the opinion of Michael Kors, improper handling, lack of care, accidents, inappropriate use, modification, attempted repair, negligence, failure to follow the advice provided in your aftercare booklet or at services.fossilgroup.com, normal wear and tear or aging.
  • Products that are not purchased from an authorized Michael Kors retailer (inclusive of authorized online retailers), Michael Kors retail store, or Michael Kors official website.

The foregoing warranties and remedies are exclusive and in lieu of all other warranties, terms or conditions, express, implied or statutory, as to any matter whatsoever, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, satisfactory quality, title and non-infringement, all of which are expressly disclaimed by Michael Kors. Michael Kors shall not be liable for incidental, consequential, indirect, special or punitive damages or liabilities of any kind arising out of or in connection with the sale or use of this product, whether based in contract, tort (including negligence), strict product liability or any other theory, even if Michael Kors has been advised of the possibility of such damages and even if any limited remedy specified herein is deemed to have failed of its essential purpose. Michael Kors’ entire liability shall be limited to replacement or repair of the purchase price paid, at Michael Kors’ sole option.

Some countries, states or provinces do not allow the exclusion or limitation of implied warranties or the limitation of incidental or consequential damages so the above limitations and exclusions may be limited in their application to you. When implied warranties may not be excluded in their entirety, they will be limited to the duration of the applicable written warranty. This warranty gives you specific legal rights; you may have other rights that may vary depending on local law. Your statutory rights are not affected.

PROVISIONS FOR FRANCE ONLY

(Translated from French version)

Regarding the legal warranty of compliance, the consumer:

- Has a two-year period starting from the delivery of the goods in which to act

- Can choose between repair or replacement of the goods, subject to the conditions of cost set out in Article L. 211-9 of the French Consumer Code

- Is required to provide proof of lack of conformity of the goods in the six months following delivery of the goods. This period was extended to 24 months from March 18, 2016, except for second-hand goods.

The legal warranty of conformity applies independently of any commercial warranty that may be provided.

The consumer can decide to implement the warranty against latent defects of goods sold as set out in Article 1641 of the French Civil Code, in which case the consumer can choose between cancellation of the sale or a reduction in the sales price, in accordance with Article 1644 of the French Civil Code.

The retailer remains responsible for the legal warranty of conformity mentioned in Articles L. 211-4 to L. 211-13 of the French Consumer Code and the warranty relating to defects of goods sold set out in Articles 1641 to 1648 and 2232 of the French Civil Code.

Article L. 211-4, L. 211-5, L. 211-12 and L. 211-16 of the French Consumer Code:

L. 211-4: “ The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery. He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility therefor or had it carried out under his responsibility.

L. 211-5: “ To conform to the contract, the product must:

 1. Be suitable for the purpose usually associated with such a product and, if applicable:

 - Correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model

 - Have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling

 2. Or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.”

L. 211-12: “ Action resulting from lack of conformity lapses two years after delivery of the product.

L. 211-16: “ When the buyer asks the seller to carry out repairs covered by his guarantee during the period of the commercial guarantee provided on purchase or repair of the product, the period of any resultant shutdown of seven days or longer shall be added to the unexpired term of the guarantee. The said period shall run from the time when the buyer requests assistance or the time when the product in question is taken out of service pending repair, should this be subsequent to the request for assistance.

Article 1641 and the first paragraph of Article 1648 of the French Civil Code:

1641: “ A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them.

1648 paragraph 1: “ The action resulting from redhibitory vices must be brought by the buyer within a period of two years following the discovery of the vice.”
